Evatric Terms of Use (for Public)

INTRODUCTION

These Terms of Use ("Terms") govern your access to and use of the Evatric AI-powered assessment platform ("Platform") as a non-business user (e.g., a job candidate, employee, or assessment participant) ("User" or "You").

The Platform is made available to you by EVA INNOVATION BİLİŞİM YAZILIM VE DANIŞMANLIK LİMİTED ŞİRKETİ ("Evatric") on behalf of a business customer ("Customer" or "Employer") who has invited you to take an assessment.

By using the Platform, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction). If you are under this age, you shall not use the Platform.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

Personal Data collected directly by us while you are interacting with our Service is subject to our Privacy Policy. If you are not accepting our Privacy Policy you shall not use our Platform.

RELATIONSHIP BETWEEN PARTIES

Evatric provides the software platform and AI technology acting as a service provider to the Customer.

The Customer is The Employer or Recruitment Agency that invited you to take the assessment. The Customer is responsible for configuring the assessment, selecting candidates, and making all hiring or employment decisions. Human Oversight requirements primarily will be applied to the Customer.

EVATRIC DOES NOT MAKE HIRING DECISIONS. WE PROVIDE DATA AND REPORTING TO THE CUSTOMER, WHO RETAINS SOLE DISCRETION OVER YOUR APPLICATION OR EMPLOYMENT STATUS.

1. LICENSE AND ACCESS RESTRICTIONS

Subject to these Terms, Evatric grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for the purpose of completing the assessments assigned to you by the Customer.

YOU MAY NOT:

  1. Copy, screenshot, record, or distribute any assessment content (questions, code snippets, challenges), which are the confidential intellectual property of Evatric or the Customer.
  2. Reverse engineer, decompile, or attempt to extract the source code or algorithms of the Platform.
  3. Share your login credentials or unique assessment links with anyone else.

2. SYSTEM OUTPUT

Evatric retains all rights, title, and interest in and to the Platform and its "Output" (including assessment reports, scoring methodologies, and system responses). You acknowledge that you have no ownership rights in these Outputs. You are strictly prohibited from using any excerpts of the Output to reverse engineer, decrypt, or analyze Evatric's proprietary knowledge or algorithms.

You agree that Evatric may legally process your assessment inputs and results to create Anonymized Data (data from which your direct and indirect personal identifiers have been permanently removed/annihilated). EVATRIC RETAINS THE RIGHT TO USE THIS ANONYMIZED DATA TO TRAIN, IMPROVE, AND BENCHMARK ITS AI SYSTEMS INDEFINITELY.

3. ASSESSMENT INTEGRITY AND ANTI-CHEATING

You agree to complete all assessments honestly and independently.

Evatric employs fraud detection technologies ("Anti-Cheat Signals"). If cheating is detected:

  1. Your assessment results will be flagged to the Customer.
  2. Your access to the Platform may be suspended or terminated.
  3. The Customer may disqualify your application based on their internal policies.

YOU ARE PROHIBITED FROM;

  1. Taking an assessment on behalf of someone else or allowing someone else to take it for you.
  2. Using unauthorized AI tools (e.g., ChatGPT, Copilot) to generate specific answers during the assessment.
  3. Copying code or answers from external sources.
  4. Using secondary devices, virtual machines, or software to bypass proctoring or browser lockdown measures.
  5. Uploading or transmitting viruses, malware, or harmful code.
  6. Attempting to probe, scan, or test the vulnerability of the system or breach security measures.
  7. Harassing, threatening, or using abusive language towards Evatric support staff or the Customer (Employer)
  8. Submitting content that is unlawful, defamatory, or obscene.

4. INTERACTION WITH AI SYSTEMS

You have hereby informed that:

  1. WHILE YOU ARE TAKING ASSESSMENTS ON EVATRIC PLATFORM YOU ARE INTERACTING WITH AN ARTIFICIAL INTELLIGENCE SYSTEM.
  2. The Platform uses AI to analyze your code, responses, and behavior to generate an assessment report for the Customer.
  3. The AI assists the Customer but does not replace human decision-making. The Customer is the "Deployer" of the system and is responsible for human oversight of the results.
  4. YOU HAVE THE RIGHT TO REQUEST HUMAN OVERSIGHT FOR ANY DECISION THAT PRODUCES LEGAL OR SIMILARLY SIGNIFICANT EFFECTS CONCERNING YOU. AS THE DECISION-MAKER, THE CUSTOMER REPRESENTS THE AUTHORITY TO PROVIDE HUMAN OVERSIGHT.
  5. Evatric is not responsible for the availability, accuracy, or security of third-party services (e.g., identity verification providers, coding environments) that may be integrated into the assessment.

5. Data Protection and Privacy

  1. The Customer (Employer/Agency) is the Data Controller. They hold and control your Personal Data, including but not limited to: Your Name, Surname, CV / Resume, Contact Details, and Application History.
  2. You acknowledge that while the Customer is the Controller of your application data, Evatric acts as an independent Data Controller for platform security, integrity logs, and anti-cheat data, as detailed in our Privacy Policy.
  3. Evatric as a Data Processor, processing data only as strictly necessary to conduct the technical assessment (e.g., analyzing code, chat inputs). We do not verify identity documents.
  4. Personal Data collected directly by us while you are interacting with our Service is subject to our Privacy Policy.
  5. Except the Personal Data provided directly to us, for execution of your rights over all your personal data collected by the Customer (including your curriculum, name and surname, age, education, addresses etc) you MUST direct any questions or requests regarding your Personal Data (including rights to access, correction, deletion, or questions about hiring decisions) directly to the Employer or Recruitment Agency that invited you.
  6. Evatric cannot fulfill these requests directly, as we act solely as Data Processor on behalf of and under the instructions of the Customer.

6. Disclaimers

  1. The Platform is provided "AS IS" without warranties of any kind. Evatric does not guarantee that the Platform will be error-free or uninterrupted.
  2. Completion of an assessment does not guarantee a job offer, interview, or any specific outcome.
  3. AI systems are probabilistic and may contain errors or biases. Evatric disclaims liability for the accuracy of AI-generated scores. It is the Customer's obligation to review these scores.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EVATRIC SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF OPPORTUNITY OR REPUTATION, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM OR THE HIRING DECISIONS MADE BY THE CUSTOMER.

8. General

These Terms are governed by the laws of Türkiye. Disputes shall be settled by Istanbul Courts.

We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the changes.

IP ownership, AI Training License, and Liability Limits shall be binding post-termination.
