1. DATA CONTROLLER

Evatric acts as an independent Data Controller strictly for the technical assessment data, anti-cheat monitoring, and platform security logs. We determine how this specific data is processed to ensure the integrity of the assessment. The Data Controller for this Privacy Policy regarding the Candidates who are taking technical interview ('You', 'End User', 'Candidate') is:

The company you applied to (the "Employer") remains the separate Data Controller for your CV, job application, and hiring decision. We share your assessment results with them. The Employer remains responsible for and has liberty on the final hiring decision.

OUR TECHNICAL ASSESSMENTS AND INTEGRITY MONITORING UTILIZE ARTIFICIAL INTELLIGENCE (AI) SYSTEMS.

YOU ARE INTERACTING WITH AN AI SYSTEM THAT ANALYZES YOUR ANSWERS, CODE AND BEHAVIOR.

IF YOU ARE WILLING TO OPT OUT FROM AI INTERVIEW PLEASE CONTACT THE EMPLOYER.

In accordance with AI regulations and our Terms of Service, you have the right to request Human Oversight regarding any flag or automated result. Evatric will evaluate such requests for technical and procedural validity and, where appropriate, involve human intervention to re-examine the results. Otherwise Authorized Users might advise the Customer for Human Oversight rights of theirs.

2. DATA WE COLLECT DIRECTLY

To provide a secure and fair technical assessment, we collect and process the following data during your active session:

1. Session Content: Your code submissions, text and file answers, and chat logs with our AI.
2. Behavioral Biometrics: Keystroke dynamics, mouse movements, clicks, and focus events (detecting tabs/windows switching), and copy-paste actions. Session logs track time per question, submission rhythms to flag lookups or secondary devices.
3. Device & Connection Information: IP addresses, geolocation, and device fingerprints verify candidate location and detect VPNs, proxies, operating system, browser version, and screen resolution.
4. Environmental Monitoring (Video & Audio): Webcam streams, screen recordings, and audio signals are processed to monitor for the presence of unauthorized persons or coaching. Browser lockdown events, device connections, and hardware activity to prevent workarounds.

We analyze this data to detect: (i) presence of other individuals, (ii) use of secondary devices, (iii) absence from the screen, or (iv) other suspicious behavioral and environmental factors.

Evatric directly collects and analyzes raw data (full video streams, detailed keystroke logs etc.)

We do NOT share the full raw datasets with the Employer by default. Instead, the Employer receives an "Integrity Report" and "Technical Interview Scoring" containing the analysis results and specific verification snapshots (photos) where necessary to validate a flag.

Integrity Report Disclaimer:

The "Anti-Cheat Signals" generated by our system are probabilistic indicators only. A flag in the Integrity Report does not constitute a definitive legal accusation of fraud or "cheating." The report serves as an invitation for the Employer to conduct a human verification of the session. The Employer is responsible for reviewing these signals before making any negative decision based on them.

5. DATA RETENTION SCHEDULE

We balance data minimization with the mandatory logging requirements.

6. INTERNATIONAL DATA TRANSFERS

Our servers are located in Germany (EU). However, certain AI processing tasks proceed in the United States and certain data tagging tasks proceed in the United Kingdom.

We protect these transfers using Standard Contractual Clauses (SCCs) approved by the EU Commission and relevant authorities, ensuring your data remains protected under standards equivalent to GDPR and KVKK.

YOU HEREBY ACCEPT AND CONSENT FOR YOUR PERSONAL DATA TO BE TRANSFERRED TO GERMANY AND PROCESSED BY OUR SUBPROCESSORS IN UNITED STATES OF AMERICA AND UNITED KINGDOM.

YOU HEREBY AUTHORIZE US TO PROCESS, TRANSFER, STORE YOUR DATA IN THE TÜRKİYE, EUROPEAN UNION, EUROPEAN ECONOMICAL AREA, UNITED KINGDOM AND UNITED STATES OF AMERICA.

You understand and accept that our subprocessors might process available data to third party sub-processors. We hereby undertake and warrant that your data will be kept in accordance with Personal Data regulations applicable for you. We will safeguard your data with relevant Standard Contractual Clauses and Data Processing Agreements.

7. YOUR RIGHTS REGARDING YOUR DATA

As the Data Controller, Evatric ensures you can exercise all rights granted under the Personal Data Laws. With respect to EU and Türkiye data protection regulations you have the right;

To know how and why your data is being processed.

To receive a copy of your personal data held by Evatric.

To correct inaccurate or incomplete data.

To request the deletion of your data when it is no longer necessary.

To object to processing based on "Legitimate Interest" or profiling.

To receive your data in a structured, machine-readable format.

To stop video/audio processing at any time (this will terminate the assessment).

To seek compensation for damages resulting from unlawful processing.
